The real estate sales tax in the Republic of Croatia is taxed at a uniform tax rate of 3% of the total agreed purchase and sale price of the property.
The seller of real estate is subject to income tax only in a situation where he sells the purchased property before the expiration of three years from the date of purchase and at a price higher than the price at which he purchased it. Then, on the difference between the purchase and sale price of the property, he is obliged to pay a tax in the amount of 35% plus tax, which is different, depending on which part of the Republic of Croatia the taxpayer resides.
Depending on whether it is a rental of a room or apartment and whether the lessor is a legal person or a natural person. When a natural person rents a property, the tax base is calculated by deducting the lump sum costs (30%) from the rental amount. If the base thus obtained is less than HRK 2,400 per month, it is taxed at the rate of income tax of 20% plus tax, and if higher, at the rate of 35% plus tax.
In cases where a legal entity rents out real estate to a legal or natural person, VAT is paid, and instead of income tax, at the end of the year, a corporate tax in the amount of 20% of the total profit received is paid. When renting rooms and adjoining rooms, all taxes are calculated in the same way, the only thing is a smaller tax base since the flat costs increase from 30% to 50%.
After the conclusion of the contract of sale, the Notary Public will officially report the purchase to the competent tax office, within 30 days counting from the date of certification of the Contract. The buyer is also obliged to pay the tax within 15 days from the date of issuance of the decision from the competent Tax Administration, and if he does not pay it within this period, the Tax Administration charges interest for each day of exceeding the deadline.
According to the amended Law on Property and Other Real Rights, since February 1, 2009, citizens and legal entities from the countries of the European Union can buy real estate in Croatia without any special conditions. Namely, the same conditions that apply to Croatian citizens for the purchase of real estate apply to citizens of the European Union. The only restriction on the acquisition of ownership concerns the circulation of agricultural land and protected areas of nature.
